第三責任險理賠外的問題

我的車於十字路口在主幹道上被有 "讓"字的支道車撞了。(雙方人員無傷、無喝酒)

對方車方向 "→" ，我車方向 "↑" (垂直撞進來，左輪凹陷傷底盤，初估維修費10萬)

保險員電話打來說一般是判7:3 (或許需3成的責任)，但保險員只初聽雙方說詞，當時他還不知道支道有"讓"字，至今三天了，還未知道判定結果。

問題1. 判定 7:3 的依據是怎判定的？為何我被撞不能全賠？

問題2. 這三成我一定需要自已出錢嗎？可否請對方賠？

問題3. 除了這三成我是否可另外要求代步車費用嗎？(天天往返彰化和美至台中，車相當重要)
