你的情形是屬於訴訟外和解

「訴訟外和解」僅有私法上的效力，

也就是說，跟一般契約一樣的意思，

如果一方不履行時，不可以直接向法院請求強制執行。

必須起訴請求對方履行和解契約，

等法院判決確定後取得執行名義，才能請求強制執行
