男店員原是狼 便利店男男猥褻

（中央社記者蔡沛琪台北20日電）一名男大學生3年前打工擔任便利商店店員，竟在倉庫等地猥褻性侵上門的鄰近國中生。最高法院依妨害性自主罪判刑4年定讞。

法院判決指出，就讀科技大學的范姓學生，利用課餘時間到南投一家便利商店打工，輾轉結識就讀鄰近國中的被害人。他從民國100年起，利用被害人放學後和同學上門消費的機會，兩度把被害人拉到店內的冰箱旁，伸出鹹豬手撫摸被害人下體。

食髓知味，後來又趁著被害人上門消費落單時，將被害人拉進店內倉庫內，趁機脫褲口交得逞。後來同學發現被害人表情怪怪的，一再追問「你該不會被他怎樣吧」，被害人脫口反問「妳怎麼知道？」後來向老師報告，並報警處理。

法院審理時，被告辯稱是在玩的時候，不小心碰到對方。法官認定他犯行明確，考量他犯後認罪，並和被害人家屬和解，依妨害性自主罪判刑4年，案經最高法院駁回上訴定讞。1030920
